Welcome to Pink Lemonaid’s website: www.pinklemonaidstand.org. The Pink Lemonaid website (the "Site") is comprised of various web pages operated by Pink Lemonaid. www.pinklemonaidstand.org is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of www.pinklemonaidstand.org constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

www.pinklemonaidstand.org is a Nonprofit E-commerce Site

Pink Lemonaid is a nonprofit 501(c)(3) organization dedicated to raising breast cancer awareness. Pink Lemonaid's site will annually release garments for sale online and profits will be donated to other nonprofit breast cancer organizations.

Privacy

Your use of www.pinklemonaidstand.org is subject to Pink Lemonaid's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Electronic Communications

Visiting www.pinklemonaidstand.org or sending emails to Pink Lemonaid constitutes electronic communications. Terms of Sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are limited to the USA and subject to any delays resulting from postal delays which we will not be responsible.

In order to contract with Pink Lemonaid you must be 18 years of age or over and possess a valid credit or debit card issued by a bank acceptable to us. Pink Lemonaid retains the right to refuse any request made by you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. Due to the seasonal, limited availability of Pink Lemonaid products, a contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Pink Lemonaid has made every effort to display our products and colors as accurately as possible. The displayed colors of each product depend on the user’s monitor and Pink Lemonaid can’t guarantee that the user’s monitor will accurately portray the actual colors of the products.

The Service is controlled, operated and administered by Pink Lemonaid from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. Termination/Access Restriction

Pink Lemonaid reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of California and you hereby consent to the exclusive jurisdiction and venue of courts in California in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Pink Lemonaid as a result of this agreement or use of the Site. Pink Lemonaid's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Pink Lemonaid's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Pink Lemonaid with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Pink Lemonaid with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Pink Lemonaid with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent an d subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to Terms

Pink Lemonaid reserves the right, in its sole discretion, to change the Terms under which www.pinklemonaidstand.org is offered. The most current version of the Terms will supersede all previous versions. Pink Lemonaid encourages you to periodically review the Terms to stay informed of our updates.
